Federal Court Strikes Down Illinois “Assault Weapon” Ban
In a significant victory for gun rights advocates, a federal court has overturned Illinois’ ban on semi-automatic firearms and their magazines.
The Firearms Policy Coalition (FPC) announced on November 8 that Federal District Court Judge Stephen P. McGlynn ruled the Protect Illinois Communities Act (PICA) is unconstitutional. PICA includes a ban on semi-automatic firearms and their magazines, which the court determined is “an unconstitutional affront to the Second Amendment and must be enjoined. The government may not deprive law-abiding citizens of their guaranteed right to self-defense as a means of offense.”
Even though the judge ruled PICA unconstitutional, the injunction has been stayed for 30 days, giving the state the opportunity to appeal the decision.
“We will continue to fight forward until we eliminate every unconstitutional ban like this throughout the country,” FPC President Brandon Combs said in a statement.
Motorcyclist Shoots Hammer-Weilding Driver in Road Rage Incident
A motorcyclist has claimed self-defense in a fatal road rage incident in Glen Burnie, Maryland.
The incident occurred on November 8, when Anne Arundel County police say a 22-year-old motorcyclist and a 51-year-old motorist had an altercation while traveling in the area of Maryland Route 10 and Furnace Branch Road, according to a WBAL news article.
“The other individual — the 51-year-old — rode behind him [the motorcyclist]. He [the motorcyclist] described him as driving erratically, tailgating at one point. He pulled up beside him yelling in his direction,” Anne Arundel County police spokesman Justin Mulcahy told WBAL.
The motorcyclist told police the other driver ran him off the road, then started coming toward him while carrying a hammer. The motorcyclist, who was licensed to conceal carry, shot the other driver in what he said was self-defense. The man died at the scene.
“He ultimately had to lay down his bike and then fire when the individual was coming in his direction with this hammer,” Mulcahy said.
The case is still active and is being investigated as an assault and homicide, according to 11 News.
